Referral Program Terms and Conditions 

By participating in the Marine Thinking Inc. Referral Program (hereinafter referred to as "the Program"), you agree to abide by the following terms and conditions:

1. Eligibility:

To participate in the Program, you must be at least 18 years of age and possess the legal capacity to enter into binding agreements.

2. Program Overview:

The Program allows participants (hereinafter referred to as "Referrers") to refer individuals (hereinafter referred to as "Referees") to purchase Marine Thinking Inc. products and receive rewards for successful referrals.

3. Referrer Obligations:

  • Referrers must provide accurate and truthful information when registering for the Program.
  • Referrers must comply with all applicable laws and regulations when participating in the Program.
  • Referrers must not engage in any fraudulent activity or actions that are in violation of these terms and conditions. Marine Thinking Inc. reserves the right to terminate a Referrer's participation in the Program for non-compliance or suspected fraudulent activities.

4. Referral Code:

  • Upon approval, Referrers will receive a unique referral code to share with Referees.
  • Referrers are responsible for ensuring that Referees correctly use their referral code.
  • Referral codes cannot be applied retroactively to purchases that were completed before the Referee received the code.
  • Only one referral code may be used per transaction.
  • Referrers are prohibited from pushing their referral code to customers who already possess a referral code from another party. Respect for the customer's initial referral choice is paramount. Violation of this principle may result in termination from the Program.

5. Discount and Reward Structure:

  • Referrers will receive a 5% cash reward for each successful referral.
  • Referees will receive a 3% discount on the total purchase price when using a valid referral code.
  • Referrers will receive their 5% cash reward based on the total purchase price paid by the Referee after confirming the transaction as a successful referral.
  • A 'successful referral' is defined as an instance where a Referee completes a purchase using the Referrer's unique referral code, and Marine Thinking Inc. receives full payment for the purchase.

6.Payment Details:

  • Referrers must provide accurate payment details (electronic transfer, wire transfer, direct deposit, PayPal) to receive cash rewards.
  • Marine Thinking Inc. shall not be liable for any inaccuracies in the payment details provided by Referrers.
  • Cash rewards will be issued to the Referrer's provided payment account within two weeks of order receipt.
  • Referrers are solely responsible for any tax implications resulting from receiving cash rewards.

7. Discount Usage Limitation:

The 3% discount for Referees cannot be used in conjunction with any other discounts.

8. Exclusive Application to Marine Tracer USV Series:

This Program is exclusively applicable to the Marine Tracer TM USV series products. Any referrals, purchases, or rewards related to other products or services offered by Marine Thinking Inc. are not covered by this Program.

9. Modification and Termination:

  • Marine Thinking Inc. reserves the right to modify or terminate the Program at any time without prior notice.
  • Any modifications to the Program will be immediately effective upon publication on the Marine Thinking Inc. Website.

10. Limitation of Liability:

  • Marine Thinking Inc. shall not be liable for any damages, losses, or expenses incurred as a result of participating in the Program.
  • Participants agree to indemnify and hold Marine Thinking Inc. harmless from any claims arising from their participation in the Program.

11. Applicable Law and Jurisdiction:

The terms and conditions shall be governed by Canadian law and interpreted in accordance with the laws of Nova Scotia, Canada, without regard to its conflict of law provisions.

12. Interpretation Clause:

All interpretations of the Program shall be at the sole discretion of Marine Thinking Inc. and shall be final and binding.

13. Data Privacy Clause:

  • Marine Thinking Inc. respects Referrers' privacy and will protect Referrers' personal data. By participating in this Program, you consent to Marine Thinking Inc. collecting, using, and processing Referrers' personal data to manage the Program and send you related notifications.
  • Referrers' personal data will only be used for the purposes of the Program and will not be shared with any unauthorized third parties unless required by law or authorized by you.
  • Marine Thinking Inc. will take reasonable measures to protect the security of Referrers' personal data and implement necessary technical and organizational measures to prevent data loss, misuse, or alteration.

14. Intellectual Property Clause:

Marine Thinking Inc. owns all intellectual property rights associated with this Program, including but not limited to trademarks, logos, marketing materials, etc.

15. Audit Rights:

Marine Thinking Inc. reserves the right to audit referral transactions to ensure compliance, requiring full cooperation from Referrers.

16. Acknowledgment of Terms:

By participating, Referrers confirm they have read, understood, and agreed to these terms. This Program is distinct and separate from any distributor program, and the benefits and terms outlined herein do not apply to Marine Thinking Inc.'s distributor relationships or programs.
